These Terms of Service govern the use of the website serafinit.com and all services provided by:

By accessing this website or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Provided

SerafinIT provides the following services:

2.1 NIS2 Compliance Engine (automated platform)

A structured assessment tool that evaluates a company's compliance posture against the EU NIS2 Directive (Directive EU 2022/2555) across 13 defined domains. The platform produces a maturity score, gap analysis, and prioritised remediation roadmap.

• Free tier: Company profile, scope determination, full 13-domain assessment, overall maturity score, and preview of the first 3 domain analyses.
• Paid tier (€690): Full domain-by-domain analysis, complete gap register, prioritised remediation roadmap, quick wins, and 30-day report access.

2.2 Advisory services

Strategic, financial, regulatory, and cybersecurity advisory services provided directly by SerafinIT consultants. These are governed by separate engagement letters or service agreements.

2.3 NIS2 Knowledge Hub

Informational content about NIS2, DORA, the EU AI Act, and related regulatory frameworks, provided free of charge for educational purposes.

3. Important Disclaimer — Automated Assessment Tool

The NIS2 Compliance Engine is an automated indicative assessment tool. It is subject to the following important limitations:

• It does not constitute legal advice, regulatory advice, or professional cybersecurity consultancy.
• It does not guarantee, certify, or confirm compliance with NIS2 or any other regulation.
• Results are based entirely on self-reported answers provided by the user. SerafinIT does not independently verify any information submitted.
• The assessment may not capture all nuances of your specific sector, jurisdiction, or operational environment.
• National transposition of NIS2 varies across EU member states. Local requirements may differ from the general framework assessed by this tool.
• Automated analysis and recommendations may contain errors or omissions.

4. Payment Terms

4.1 Pricing (not currently active - see pilot notice above)

Once paid access is activated, the full NIS2 Compliance Report will be available for a one-time fee of €690 (excluding applicable VAT). VAT will be applied in accordance with EU VAT rules based on your location and tax status:

• B2B clients with a valid EU VAT number: reverse charge applies; you account for VAT in your country.
• B2C clients (private individuals) within the EU: VAT at the rate applicable in your country of residence will be charged.
• Clients outside the EU: no EU VAT applies.

4.2 Payment processing

Payments are processed securely via Stripe Inc. By completing a payment, you also agree to Stripe's Terms of Service. SerafinIT does not store payment card details.

4.3 Invoicing

A VAT-compliant invoice will be issued automatically upon successful payment. For B2B clients, please ensure your correct company name, registered address, and VAT number are entered at checkout to receive a correctly issued invoice.

4.4 Access

Upon successful payment, you will receive access to your full compliance report for a period of 30 days. We recommend downloading or saving your report within this period.

4.5 Refund policy

Given the nature of digital services and the immediate generation of the full report upon payment, we do not offer refunds once the full report has been accessed. If you experience a technical issue preventing access to your report, contact us at info@serafinit.com within 7 days and we will resolve the issue or provide a full refund.

5. Acceptable Use

When using serafinit.com and the NIS2 Compliance Engine, you agree to:

• Provide accurate and truthful information in all assessment answers
• Use the platform only for its intended purpose — assessing your organisation's NIS2 compliance readiness
• Not attempt to reverse-engineer, copy, scrape, or reproduce the platform's assessment logic, questions, or report content
• Not use the platform to generate reports for third parties for resale without a written agreement with SerafinIT
• Not attempt to circumvent the payment gate or access paid content without completing payment

6. Intellectual Property

All content on serafinit.com — including text, design, assessment questions, scoring methodology, report templates, and AI prompts — is the intellectual property of SerafinIT Ltd and is protected under applicable copyright and intellectual property law.

Your compliance report, once purchased, is licensed to you for internal business use only. You may not reproduce, distribute, or publish the report or any part of it without SerafinIT's written consent.

References to the NIS2 Directive, ENISA guidance, and other regulatory documents are made in accordance with applicable open licensing terms (Creative Commons where applicable).

7. Limitation of Liability

To the maximum extent permitted by applicable law, SerafinIT Ltd shall not be liable for:

• Any regulatory penalties, fines, or enforcement actions arising from reliance on the assessment results
• Any business losses, reputational damage, or consequential losses resulting from use of the platform
• Errors or inaccuracies in automated analysis or recommendations
• Service interruptions, technical failures, or data loss beyond our reasonable control

SerafinIT's total liability to you in connection with any single transaction shall not exceed the amount paid by you for that transaction.

8. Data Protection

Your use of our services involves the processing of personal and company data. This is governed by our Privacy Policy, which forms part of these Terms and which you accept by using our services.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria. Any disputes arising from or related to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the competent courts of Bulgaria.

For EU consumers, this does not affect any mandatory consumer protection rights you may have under the law of your country of residence.

10. Changes to These Terms

We may update these Terms from time to time. The current version will always be available at serafinit.com/terms.html. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

For material changes affecting paid services, we will notify active clients directly.
